1. Introduction
1.1 Thesespecialservicetermsandconditionsaresupplementarytothe
AustraliaPostTermsandConditionsandtotheextentthatanyaspectof
thisspecialserviceisnotexpresslyincludedherein,theAustraliaPost
termsandconditionsapply.
1.2 Thesespecialservicetermsandconditionsapplywhen:
1.2.1 acustomermakesawrittenapplicationtousethespecialservicein
oronaformprescribedbyAustraliaPostforthatpurpose;
1.2.2 AustraliaPostacceptsthatapplication;and
1.2.3 thecustomerpaysthefee,charge,premium,rateorpricecharged
byAustraliaPostforthespecialservice.
2. Interpretation
2.1 Exceptaswhereotherwiseexpresslydefinedallwordsandphrasesused
inthisagreementshallhavethesamemeaning(ifany)giventotheminthe
Australian Postal Corporation Act 1989andintheAustraliaPostTerms
andConditionsprovided,howeverthatwherethereisanyinconsistency,
themeaningshallbeasdefinedthisagreementtotheextentofthat
inconsistency.
2.2 Inthesetermsandconditionsunlessthecontraryintentionappears:
2.2.1 whereawordorphraseisgivenaparticularmeaning,otherparts
ofspeechandgrammaticalformsofthatwordorphrasehavea
correspondingmeaning;
2.2.2 wordsimportingagenderincludeanyothergender;and
2.2.3 wordsinthesingularnumberincludethepluralandwordsinthe
pluralnumberincludethesingular.
2.3 “agreement”meansanagreementbetweenAustraliaPostanda
customerpursuanttoclause1.2;
2.4 “bag”meansalockedbagapprovedbyAustraliaPostforuseinthe
service;
2.5 “box”meansapostofficeboxsuppliedbyAustraliaPostforuseinthe
service;
2.6 “common box”referstopostofficeboxeswhicharelocatedatGPOs,
eachhavingacommonboxnumber;
2.7 “customer”meansthepersonorbodyinwhosenametheapplicationfor
useoftheserviceismadeandanyauthorisedtransfereeorassigneethereof;
2.8 “mail”intheMail2Day®Servicemeansallarticlesaddressedorunaddressed.
2.9 “Mail2Day®Service” meanstheelectronicmailalertboxservice
whichisaspecialservicesuppliedbyAustraliaPost(atparticipating
outlets)forthepurposeofnotifyingboxholdersbyelectronicmailor
SMSthatanarticleisawaitingcollectionatthecustomer’sbox.
2.10 “service” meansthepostofficebox,lockedbagorcommonbox
suppliedbyAustraliaPostforthepurposeofmaildelivery.
3. Period of service
3.1 Theservicemaybeprovidedforanindefiniteperiodunlesscancelledor
terminatedsoonerinaccordancewiththesetermsandconditions.
4. Charges
4.1 ChargesforuseoftheserviceshallbedeterminedbyAustraliaPostand
arepayableinadvance.
4.2 Chargeswillbecalculatedfromthefirstdayofthecalendarmonthin
whichtheservicecommencestothelastdayinthecalendarmonthin
whichtheserviceends.Apartofamonthischargedasafullmonth.
4.3 Wheretheagreementiscancelledpursuanttoclause12,thecustomer
isentitledtoarefundcalculatedontheremainingnumberofwhole
calendarmonthspaidfor,lessacancellationfeedeterminedby
AustraliaPost.Arefundwillnotbepayablewheretheagreementis
terminatedbyAustraliaPostunderclause14,orwheretheamountof
therefundisequaltoorlessthanthecancellationfee.
5. Conditions of service
5.1 ThecustomershallcomplywithalltherequirementsofAustralia
PostfortheserviceaspublishedincludingprovidingtoAustralia
Postacurrentelectronicmailaddressormobilephonenumberifthe
Mail2Day®Serviceisrequested.
5.2 WhereacustomerhaschosentheMail2Day®Service,thecustomer
warrantsthatitis:
5.2.1 Theowneroftheelectronicmailaddressand/ormobilephone
number;or
5.2.2 authorisedtousetheelectronicmailaddressand/ormobile
phonenumberforthepurposeoftheMail2Day®Service.
5.3 ForthepurposesoftheMail2Day®Service,AustraliaPostwillsendone
messageperdaytothecustomer/account,andatsuchtimeasthe
messageissent,itwillbedeemedtohavebeensentbyAustraliaPost
andreceivedbythecustomer.

6. Box keys
6.1 BoxkeysremainthepropertyofAustraliaPostandmaynotbecopied.Key
cuttingcanbearrangedonlybyAustraliaPost.
6.2 BoxkeysshallbeimmediatelyreturnedtoAustraliaPostuponthe
cancellation,terminationorexpirationoftheagreement.
7. Delivery of mail
7.1 Allmail,addressedtoacustomer’sstreetaddress,willbedeliveredas
addressed,unless:
7.1.1 amailredirectionisinplaceforthestreetaddressedmail;or
7.1.2 AustraliaPostdeterminesthatitisappropriateintheinterests
ofnetworkmanagementtodeliverstreetaddressedmailtothe
customer’sbox.
7.2 Nofeeappliestotheredirectionofmailfromastreetaddresstoapost
officeboxorlockedbagforsixmonthsfollowingtheinitialapprovalofthe
application.
8. Postal address
8.1 Thecustomermustshowtheirpostaladdress,includingtheirboxorbag
number,prominentlyonletterheads,otherappropriatestationeryandinany
advertising,preferablywiththerequestthatallmailbeaddressedtothat
postaladdress.
9. Locked Bag service requirements
9.1 BagsusedforthelockedbagservicearetobepurchasedonlyfromAustralia
Post
9.2 Priortothecommencementofthelockedbagservicethecustomermust
providetoAustraliaPostalockandkeyofatypeapprovedbyAustraliaPost
forthepurpose.
10. Transfer of service
10.1 Acustomershallnotassignortransfertherighttousetheservicewithoutthe
priorwrittenconsentofAustraliaPostandthepaymentofatransferfee.Any
assignmentortransferwithoutsuchconsentwillbevoidandofnoeffect.
10.2 Whereapartnershipholdingaboxorbagisreconstitutedbytheretirement,
deathoradditionofmorepartners,thereconstitutedpartnershipisdeemed
tobethecustomer.
11. Change of address
11.1 ThecustomershallnotifyAustraliaPostinwritingwithinsevendaysofany
changeofresidential,businessorelectronicmailaddressand/ormobile
phonenumberfromthatgivenontheapplication.
12. Cancellation
12.1 Thecustomermaycancelaserviceatanytimeuponsevendaysnoticein
writing.Unlessanapplicationforthechangeofaddressorholdingserviceis
made,allmailaddressedtothecustomeratthatboxorbagshall,following
thenoticeperiod,betreatedasundeliverable.Afeeappliesforthechangeof
addressservice.
13. Common box
13.1 Anapplicantforacommonboxmustleaseandretainaboxateachofthe
followingGPOs:Sydney,Melbourne,Brisbane,Perth,AdelaideandHobart;
andmayhaveaboxateither/orCanberraandDarwinGPOs.
13.2 TheMail2Day®ServiceisnotavailablewithCommonBoxservice.
14. Termination
14.1 AustraliaPostmayterminatetheagreementatanytimebygivingwritten
noticespecifyingthedateofterminationtothecustomer,if:
14.1.1thecustomerfailstoobserveorperformanyterm,covenantor
obligationcontainedinthisagreement;
14.1.2AustraliaPosthasreasontobelievethatthecustomerhasuseda
fictitiousorassumednameontheapplication;
14.1.3AustraliaPosthasreasontobelievetheaddressontheapplication
isnotthecustomer’scurrentresidential,businessorelectronicmail
address;
14.1.4theboxorbagisbeingusedforapurposeotherthanthedeliveryof
postagepaidmail;
14.1.5theboxorbagisbeingusedbyapersonorbodyotherthanthe
customer;
14.1.6AustraliaPosthasreasontobelievethatthecustomer,oraperson
knowntothecustomer,intendstouse,orisusingtheserviceinthe
furtheranceofanoffenceagainstthelawofAustraliaoranyState,
Territoryorothercountry,ortopreventthedetectionoftheoffenceor
theoffender;
14.1.7thecustomerregularlyallowsanaccumulationofmail,otherthanlarge
parcels,beyondthecapacityoftheboxorbaganddoesnotwithin30
daysafterrequestedbyAustraliaPost,obtainorprovidealargeror
additionalboxorbag;or
14.1.8AustraliaPostisnotifiedofadisputeinrelationtothedeliveryaddress
forthecustomer,provided,however,thatAustraliaPostmayterminate
thisagreementatitsabsolutediscretionwithoutnoticeandupon
terminationallundeliveredmailshallbedeemedtobeundeliverable.

15. Limitation of liability release and indemnity
15.1 Subjecttoclause15.2andAustraliaPostTermsandConditions,AustraliaPost
shallnotbeliabletoanyperson(whetherincontract,tortorotherwise)for
anylossordamagesuffered,orthatmaybesuffered,asaresultofanyactor
omission,whethernegligentorotherwise,byoronbehalfofAustraliaPostin
relationtotheprovisionoftheservice,oranyothermatterorthingrelatingto
thisAgreement.
15.2 Totheextentpermissiblebylaw,AustraliaPostexpresslydisclaimsall
conditionsandwarranties,expressorimplied,inrespectoftheservice
andthecarriageofletterspursuanttothisAgreement.Wherethelaw
precludessuchexclusionandimpliescertainconditionsandwarrantiesinto
thisAgreement,theliabilityofAustraliaPostforbreachofsuchconditionor
warrantyshallbelimited,attheoptionofAustraliaPost,toanyoneormoreof
thefollowing:
15.2.1supplyingtheserviceagain;or
15.2.2paymentofthecostofhavingtheservicesuppliedagain.
15.3 ThecustomershallreleaseandindemnifyAustraliaPostagainstanylossor
damagewhatsoeverwhichAustraliaPostmaysufferasaresultofanyaction,
proceeding,claim,demandorprosecutionarisingfromtheprovisionofthe
service,oranyothermatterorthingarisingasaresultofthisAgreement,
includinglossordamagearisingfromthenegligentactsoromissionsofAustralia
Post,pursuanttothisAgreement.
16. Force majeure
16.1 AustraliaPostshallnotbeindefaultunderthetermsofthisagreementnor
liableforfailuretoobserveorperforminaccordancewithanyprovisionofthis
agreementforanyreasonorcausewhichcouldnotwithreasonablediligence
becontrolledorpreventedbyit,includingwithoutlimitation,war,insurrection,
riot,civilcommotion,strikes,lock-outs,labourorindustrialdisputes,acts
ofGod,actsofGovernmentsorflood,storm,tempest,powershortages
orpowerfailure,inabilitytoobtainsufficientlabour,rawmaterials,fuelor
utilities.Duringtheperiodofanincidentorincidentsof“ForceMajeure”
thisagreementshallbesuspendedanddeliverywillrecommenceafterthe
incidentorincidentsof“ForceMajeure”end.
17. Merger
17.1 Alltherights,immunitiesandlimitationsofliabilityinthisagreement
shallcontinuetohavetheirfullforceandeffectinallcircumstances
notwithstandinganybreachofcontractorofanyconditionshereofby
AustraliaPost.
18. Variation
18.1 ThesetermsandconditionsmaybeaddedtoorvariedbyAustraliaPost
bynoticeinwritingtothecustomerorbymutualagreementbetweenthe
parties.
19. Notice
19.1 Anynoticerequiredtobeservedbyorunderthesetermsandconditionsshall
besufficientlygiventothecustomerifleftintheboxorbagprovidedpursuant
totheagreementandtoAustraliaPostifsentbypostorgiventotheManager
responsiblefortheofficeatwhichsaidboxorbagissituated.
20. Conditions of carriage
20.1 Theprovisionofapostofficebox,lockedbagorcommonboxserviceshallnot
constituteorimplyanyagreementbetweenAustraliaPostandthecustomer
(oranyundertakingorobligationwhatsoeveronthepartofAustraliaPost)
withrespecttothecarriageordeliveryofanypostalarticle.TheAustraliaPost
TermsandConditionsapplytothecarriageanddeliveryofpostalarticles.
21. Law
21.1 Thisagreementisgovernedby,andshallbeconstruedinaccordancewiththe
lawsinforceintheStateofVictoriaandthecourtsandregistriesofcourtsin
thatStateshallhavejurisdictionintheeventofadispute.
22. Whole agreement
22.1 Subjecttoclause1.1thisagreementcontainsthewholeoftheagreement
betweenthepartiesinrelationthespecialserviceandanyrepresentationor
warrantymadebyeitherpartypriortoenteringintothisagreementshallhave
noforceoreffectunlessotherwisestatedherein.
